Michael has tried cases before juries and judges in federal district courts in New York and in the state courts of New York and New Jersey. Michael recently participated in the successful defense of a bank in case alleging fraudulent inducement and whistleblower claims, obtaining preclusion of an expert’s report and handling expert economic testimony.
Michael has successfully defended attorneys against Racketeer Influenced and Corrupt Organizations Act (RICO), fraud, conspiracy and malpractice claims in complex litigation involving over 200 plaintiffs. He has handled various real estate disputes, including, for example, Article 78 challenges to municipal decisions as well as partition actions. He also participated in a five-month trial in federal court defending an international bank against RICO, fraud and conversion of collateral claims.
Michael started his career in the New York City Law Department Corporation Counsel, Commercial and Real Estate Divisions. He has defended businesses in numerous personal injury lawsuits. Michael also has arbitrated numerous cases.
Michael has substantial appellate experience as well, having argued appeals in the U.S. Court of Appeals for the Second Circuit and in the Appellate Divisions of New York and New Jersey.
While an active and aggressive litigator, Michael counsels his clients to take steps to mitigate the risk of litigation. He provides general corporate, contractual and employment counseling advice to numerous clients, including review of operating agreements, bylaws, shareholder agreements and contracts, to preemptively address potential disputes before they occur.
Michael has presented and written on a variety of topics affecting businesses with the goal of minimizing the risk of litigation and has presented to fellow lawyers.
Michael is active in his community. He is the incoming President of the Business Network Group of Long Island. He is past President of the Huntington Lawyers Club and The Townwide Fund of Huntington, Inc., a charity providing funding to organizations serving residents of the Town of Huntington. He was an honoree at the Townwide Fund’s 50th Anniversary Gala. Michael was a past Trustee of the Suffolk County Vanderbilt Museum and Planetarium.
Michael is dedicated to his profession and community, but still finds time for his family and activities, whether hiking, biking or golfing.
